TIITF Road Reservations On Murphy Act Deeds

There are over 800,000 properties encompassing about three million acres of real estate estimated to be encumbered with Murphy Act reservations and road easements.  In time past getting these released or declared not valid was easy.  Today it is not so easy.  Property owners are losing millions of dollars annually because of these sixty year old easements. Title Companies are paying out millions of dollars also to subsidize building roads as they pay off property owners for not excluding these reservations on policy issues. Then the State, County, or Municipality comes in and takes the easement for free claiming the property owners have already been justly compensated for them by title company settlements.  Many times these settlements are very small being purchased back in the 60s, 70s, 80s and 90s when property prices were not all that high.  With the inflation of property prices in the past five years, Florida property owners are discovering they are not covered adequately for the loss they will experience. How can this be just compensation according to constitutional law?  Why should title companies be looked to as a source for funding road right-of-way at the price of missed road easements?

Attorneys have been deceived about these road easements and have fallen into the trap of trying to understand them the way the FDEP officials representing the TIITF Board wants them to understand them.  It is now time to look at these issues from the mind of a man who is not an attorney, is not in the title insurance business, is not on the state payroll eating at the public trough, but who desires to see all property owners treated fairly with total removal of these clouds on their titles.  

I do not want to see another title insurance claim in the State of Florida for these road easements. If you are an attorney and seeking for some way to beat the State on these TIITF easements I am going to give you more information to win then you will find anywhere.  And, my information is not all on this web site.  I am keeping a few aces for later on if I personally need them.  If you are a title insurance company I am doing all I can to assist you in never paying another penny in settlements.  What I ask of you is to initiate legislative action to correct this multi-million dollar problem causing higher rates for Florida citizens.  I initiated SB 2410 in 1997 all on my own with Senator Hargrett.  I will be happy to work with any committee to start the ball rolling again to end this 60 year old land swindle.  I have drafted proposed legislation for session 2007.  All I need are a sponsor in the House and Senate.

How did I get involved in the TIITF road issue?  It started back in 1995 when the City of Tampa announced a widening project for 40th Street between Hillsborough Avenue and Fowler Avenue.  In the meetings I discovered the TIITF issue.  After several months I decided to check our Church property and went to the Court house.  On the second day of searching the chain of Title I discovered the TIITF deed. This led me on a journey to learn how to get it released.  My investigations led me to attorneys, title companies, and eventually to my elected officials.  This led me to Tallahassee and FDOT there as well as many meetings with FDEP and Jack Wolf.  I became very knowledgeable about the TIITF issue spending nearly a week in Tallahassee going through years of Minutes of the Trustee Board. I wrote letter after letter to many different people seeking information and fighting the injustice.  I am the most hated man in the City of Tampa on the matters of the TIITF reservation down at City Hall.  They got so angry at me they moved the whole road system over nearly 40 feet just so they would not have to take our Church building and not have to pay for a free attorney.  I have met with men who lied, schemed, twisted, falsely accused, and who just simply are not moral.  This year or next I am on their hit list in segment C of the widening project.  They are holding me out till last so all the others along the street will not be around to fight for me as I have fought for all of them. But, there is a power greater then the government, greater then men with jobs, greater then the TIITF Board, and with that confidence I stand, I will fight injustice, and I will win against tyranny and unfair governmental practices.
