On Murphy Act road easments
The purpose of these web pages is to draw attention to
the injustice title companies and property owners have been subjected to
for over 27 years regarding Murphy Act road easements.
The wrong began when the 51 year old (1940-1991) interpretation of Murphy Act road easements was changed by the Florida Department of Environmental Protection. The new interpretation necesitated in a change in the 51 year old Rules and Procedures of the Florida Department of Transportation, the Florida Department of Environmental Protection, and the Trustees of the Internal Improvement Trust Fund. Citizens filing for release of the TIITF reservations after 1991 were treated differently then those who obtained releases between 1940 and 1991. The Rules and Procedures promugated by FDOT in 1978 were changed between 1991-1995. The change after 51 years from 1940-1991 resulted in tremendous financial losses to both title companies and property owners.
I am seeking legislative relief on this govermental abuse. I am seeking the TIITF Board to pass a resolution that corrects these injustices.
